BitFriends is a digital wellness and entertainment platform designed to provide supportive content and user interaction through artificial intelligence technologies. This application is not a substitute for licensed professional healthcare or therapeutic services. Your use of the application is entirely voluntary and constitutes your full acceptance of all associated risks and these Terms of Use. Your data collection and privacy rights are governed by our Privacy Policy, which is incorporated by reference into these Terms.
BitFriends incorporates artificial intelligence (AI) to generate conversational and interactive experiences. You expressly acknowledge, understand, and agree that:
• AI-generated content may be unpredictable, inaccurate, misleading, inappropriate, offensive, or completely wrong
• AI responses may appear authoritative but lack actual expertise or medical knowledge
• AI may generate responses that seem personalized but are based on pattern recognition, not genuine understanding
• AI cannot replace human judgment, professional advice, or critical thinking
• You will not rely on AI-generated content for medical, legal, financial, or other professional decisions
BitFriends, its affiliates, and licensors make no guarantees as to the accuracy, reliability, or safety of AI outputs. You accept full responsibility and risk for any reliance on AI-generated content. BitFriends disclaims all liability for any consequences resulting from interaction with AI features, including but not limited to emotional distress, poor decisions, or reliance on inaccurate information. Use of this application signifies your agreement to these conditions and your release of BitFriends from any and all claims or liabilities associated therewith.
BitFriends does not provide professional medical, psychiatric, or psychological advice, diagnosis, or treatment. All content within the application is intended for general informational and entertainment purposes only. The AI within BitFriends is not trained as a medical professional and cannot recognize or respond appropriately to crisis situations.
If you are experiencing a mental health crisis, thoughts of self-harm, or any medical emergency, contact emergency services (911 in the US) or a licensed healthcare provider immediately. Do not rely on BitFriends for crisis intervention or urgent medical guidance. BitFriends is not responsible for any decisions made based on content generated by the application.
You must be at least sixteen (16) years of age to access and use BitFriends. Age verification is based on self-reported information during onboarding. By using this application, you affirm and represent that you meet the minimum age requirement and are legally capable of entering into this agreement. Providing false age information is a violation of these Terms and may result in immediate account termination.
The BitFriends application and all its content are provided solely for entertainment and self-reflective purposes. Any responses or interactions with the artificial intelligence features are fictitious and should not be construed as factual, accurate, or advisory in nature. Users should not make important life decisions based on AI interactions within the app.
To the maximum extent permitted by law, BitFriends, its developers, officers, agents, affiliates, licensors, and service providers shall not be held liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with your use of or inability to use the application, including but not limited to:
• Damages resulting from AI-generated content or advice
• Loss of data, conversations, or user-generated content
• Emotional distress or psychological harm
• Business interruption or lost profits
• Third-party service failures or outages
• Security breaches or unauthorized access to data
You acknowledge and accept full responsibility for any risks associated with the use of the platform, including any emotional or psychological impact. In no event shall BitFriends' total liability exceed the amount you paid for the app in the twelve months preceding the claim, or $100, whichever is less.
You agree to use BitFriends in compliance with all applicable laws and regulations. You shall not engage in any conduct that is harmful, unlawful, abusive, harassing, defamatory, or otherwise objectionable. You specifically agree not to:
• Attempt to reverse engineer, hack, or compromise the application
• Use the app for any commercial purposes without express permission
• Share your account access with minors or unauthorized users
• Attempt to extract or misuse AI-generated content for other applications
• Use the app in ways that violate others' privacy or rights
Violation of these standards may result in immediate suspension or termination of your access, and may expose you to civil or criminal liability.
All content, including but not limited to graphics, code, data, text, trademarks, AI models, and proprietary algorithms within BitFriends, are the exclusive property of BitFriends or its licensors. Unauthorized use, reproduction, distribution, or creation of derivative works is strictly prohibited and may result in legal action. AI-generated content remains subject to these intellectual property restrictions.
BitFriends reserves the right, at its sole discretion, to suspend or terminate your access to the application at any time and for any reason, without prior notice or liability, including but not limited to violations of these Terms of Use, applicable law, or behavior that we deem harmful to other users or our services. Upon termination, you must cease all use of the application.
BitFriends may offer optional in-app purchases or subscriptions. All transactions are processed by Apple through the App Store according to Apple's terms and conditions. While BitFriends does not directly manage payment systems, we will work with Apple to resolve legitimate billing disputes. However, refund eligibility is ultimately determined by Apple's refund policies. If Apple directs refund responsibility to BitFriends, we will handle such requests in accordance with applicable consumer protection laws. All refund requests should initially be directed to Apple Support.
You agree to defend, indemnify, and hold harmless BitFriends, its officers, directors, employees, and agents from and against any claims, damages, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
• Your use or misuse of the application
• Your violation of these Terms of Use
• Your violation of any rights of another party
• Any content you submit or actions you take within the app
• Your reliance on AI-generated content contrary to these Terms
BitFriends shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, riots, civil disorders, rebellions or revolutions, or any other cause beyond our reasonable control, including third-party service outages, internet disruptions, or AI service provider failures.
These Terms of Use may be amended at any time without prior notice. Any modifications will become effective upon posting within the application or on our website. Continued use of BitFriends following any such updates constitutes your full acceptance of the revised terms. We recommend reviewing these Terms periodically for changes.
Any disputes, claims, or controversies arising out of or relating to your use of BitFriends, or to any products or services sold or distributed through the app, shall be resolved through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and not in court.
You agree to waive any right to a jury trial or to participate in a class action. The arbitration shall take place in California, unless you and BitFriends agree to another location or to conduct the arbitration by telephone or online. Each party shall bear their own costs and attorneys' fees, unless otherwise awarded by the arbitrator.
Notwithstanding the foregoing, BitFriends may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm. Small claims court actions are excluded from this arbitration requirement if they fall within the court's jurisdiction limits.
These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located within California, and you consent to the jurisdiction and venue of such courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and BitFriends regarding the use of the application and supersede all prior agreements and understandings.
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of BitFriends or these Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.
If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." If you are a resident of another jurisdiction, you waive any comparable statute or doctrine.
